Use of Embarcadero Media Photographs, Video or other Copyrighted Material

All content created by Embarcadero Media and its staff is covered by U.S. copyright laws, and the company must grant permission for a third party to republish or otherwise use any of it.

Without explicit written permission by us, the reproduction or use of all such material, including for personal, nonprofit or commercial use, is expressly forbidden.

If granted, our permission will usually be in the form of a limited license to use our copyrighted material for a specific purpose and duration. Most requests for personal use (e.g., by the subject of a photograph to share with family and friends for entirely non-commercial purposes) are granted for a small fee of $25 per photo or less.

Use by local nonprofit organizations of images taken of their activities by our staff will generally be granted, at no charge.

All other requests, whether from an individual, nonprofit organization, media company or a commercial enterprise, will be treated as commercial use and the cost will be based on the following factors: uniqueness, date originally published, cost of replicating, commercial value, desired use, duration and breadth of license. Commercial licenses of a non-replicable image can range from $250 to $2,500 or more. (As a professional courtesy, we will often provide limited permissions at no charge to local news organizations for images used in news coverage.)

When using the photos or video, credit must be given on or next to the image as follows: Courtesy (photographer’s name)/Embarcadero Media.

Please note that images that were contributed to us or taken by an intern cannot be licensed to third parties.
