Summer school fees are being refunded

Original post made by another mom, Embarcadero Oaks/Leland, on May 30, 2013

Just got an email that parents can request a refund of summer school fees to conform to the laws. Or we can let that money be a donation to the summer school program.

That's great but it's not legal. They have to give the money back, not require parents to request a refund. The email is an admission that they could not charge and that the charge was illegal. That means that the district must refund all fees collected in violation of the law, and then can solicit donations later if they desire.

Where do they get these ideas? It's legal if we only charge for credit's legal if we offer's legal if high school is free but we charge for elementary and middle school. Who is giving this kind of ridiculous legal advice to the district and how dumb do you have to be to keep following the advice of people that is proven to be bad and wrong over and over. Sheesh.

When was this law supposed to be in effect? How many years have I been paying hundreds of dollars I could ill afford for illegal fees?

I don't really get why the district is making so many mistakes. I heard a former board member grumbling about how she wished that people would stop criticizing the district. Not good for property values and whatnot. But I wondered to myself why the district doesn't straighten up and fly right. Who is going to bear the cost of refunding the money that shouldn't have been charged? The taxpayer. Who is going to bear the cost of the lawyers due to the OCR mess? The taxpayers. Why aren't district officials interested in improving their performance to an acceptable level? Because the taxpayer is footing the bill for all these errors. I would rather my money went to educating students not cleaning up after all these messes and whatnot.

@C: I am glad that the former board member you referred to in your last comment isn't a board member any longer. If property values plummeting is of more concern to him/her than damage being done to our children by neglectful, dishonest and many times incompetent administrators then he/she is not the kind of person I want looking out for the interests of our students.

The district could be defined as Superintendent Skelly. He seems to be running the district and calling ALL the shots. Skelly is supposed to be taking direction from the Board but the Board seems to be neglecting their duties which means that they are not responsive to the wishes of their constituents. I did not elect Camille and Heidi. The tax payers got what they deserve since they were not willing to listen to someone who was calling for transparency in district matters. Of course, there was much dirty politicking going on according to some of the sources I heard from...but that is water under the bridge. Now we have to deal with what we have and continue to let the Board members know that the district is seriously broken and will have to do some mighty heavy lifting to unearth the truths that have been concealed from us.

When I asked "who hired this guy anyway" several months back I was told that the board did and that Melissa was Kevin's main backer. I am wondering how she feels about her strong support of this man now especially in light of the OCR incident(s). The Board must act to find a replacement for Skelly. We, the taxpayers, cannot afford to constantly have to pay for the cost of increased legal services along with the loss of respect and prestige the district may have enjoyed once upon a time. I am really ashamed of our administrators as well as of the Board for failing to make moves towards replacing Skelly.

Our students truly deserve better!

@Spectator at Large - The story about the first OCR case told that board members were addressed by the family, asked for help. I am assuming that if the family would have been helped - the OCR would not have been addressed. The stories you heard about dirty politics, if true, can not be water under the bridge. Those tactics, if true, did not come out of nowhere. It seems to me that there is a culture and atmosphere that enable these occurrences, public education system. I think that systemic issues do not stop "there", and take very long time to build. That was the reason that had me address Ken Dauber more than 2 months ago calling to form Shadow board - look into issues and processes. It was clear to me, then, that the board was not about to appoint an investigation comity. Link to my open address- Web Link
And- all threads dealing with these issues were restricted only to those logged in. I wonder if you have any thoughts as to the reason that had this thread restricted? The other threads dealing with these issues? Floods of comments stop when the thread becomes restricted, very telling.
