In another high-stakes campaign for a seat on the Santa Clara Valley Water District's board, incumbent Gary Kremen has amassed a war chest of $272,814, which is nearly 10 times greater than that of his opponent, attorney Rebecca Eisenberg.
Her campaign received $27,978 for the period Jan. 1 through Sept. 24, according to California Fair Political Practices Commission (FPPC) financial contributions filings.
But actual contributions to Kremen's and Eisenberg's campaigns from individual donors and political action committees amounted to only several thousand dollars. In Kremen's case, it was $9,374; for Eisenberg, the individual donations amounted to $7,978.
The majority of their contributions came from the candidates themselves. Eisenberg loaned her campaign $20,000. Kremen loaned his campaign $101,000. Another $162,440 was rolled over from his campaign for county assessor, which was aborted earlier this year, through Eldridge Gary Kremen for Assessor 2022, the FPPC filings show.
Kremen is no stranger to spending huge sums of cash in his elections. He upped the stakes for funding a campaign for the Valley Water board in his 2014 inaugural bid by lending his campaign $503,000, an unheard-of sum that squashed his opponent, incumbent Brian Schmidt, who raised $20,457 during his campaign.
Of individual-donor contributions to his 2022 campaign, notable were the the Plumbers, Steamfitters and Refrigeration Fitters Local 393 Political Action Committee, which donated $1,000, the International Brotherhood of Electrical Workers Local 332 Education Fund, which donated $2,500, and Charles "Chop" Keenan, a Palo Alto developer, who donated $500.
Eisenberg's individual donors included two powerful allies: retired Santa Clara County Superior Court Judge LaDoris Cordell, who donated $500, and Kremen's former rival, County Assessor Larry Stone, who donated $2,000.
Kremen had sought to unseat Stone, an incumbent who is now in his seventh term, during the assessor's race in June primary. He dropped out in February after a former campaign staffer accused him of sexual harassment. Kremen has said he accidentally left a few photographs of himself and his partner in bed while she was breastfeeding in a large Dropbox cache of campaign photos.
Regardless of where their cash is coming from, Kremen is by far the monetary leader. As of Sept. 29, he has an ending cash balance of $233,741 after $39,072 in expenses; Eisenberg has an ending cash balance of $22,078 after $5,899 in expenditures.

I just want to clarify that per my Form 460, I raised $8600 in individual contributions through September 24 (rather than $7978). Additionally, per my filings, I raised another $11,636 between September 25 and September 30. The confusion is likely my fault so I thought I would clarify.

While not part of the incumembent's campaign report, it is worth noting this strategy of flooding many other local elections with $1,000 individual donations. Nothing illegal but one could see these donations as a way to sollicit favors such as endorsements.

Gary Kremen has done a great job representing our area on the Santa Clara County Water District Board and deserves our support to continue his good work. He has made progress on much needed flood control for San Francisquito Creek. He is a creative, innovative and collaborative leader. He is the best candidate in this race.

Specifics:
1. Infrastructure? My campaign is -based- on *infrastructure investment*. I aim to use grants from the Inflation Reduction Act, as well as funds from the trillion dollar carbon credit market to upgrade our infrastructure to enable recycling. This will lower water bills! Web Link
2. Conservation? I never said the word conservation in the debate, and I don't think it is on my website. I like conservation, but my focus has been on sustainable infrastructure. See Web Link
2. Extreme: Under my opponent's leadership, SCC recycles barely 5% of its water, half of national average and 1/6 of CA average. Bringing our recycling up to at least average is not extreme - falling behind is.
3. Extreme: My opponent champions a $3 billion dam, which will destroy miles of vulnerable ecosystems, contributing to climate change, and sacred Amah Mutsun Tribal land, including 3000 year-old artifacts. *That* is extreme. Web Link
4. Realistic: My opponent's dam will not return a fraction of its cost. He claims to have raised $485 million of the $3 billion cost, but that money is unlikely to materialize bc it relies on things that are unlikely to happen, like approval by Fish & Wildlife. Thus the Dam will be paid for by ratepayers through ever-higher water bills.
5. Combative: You mean my opponent, who being investigated for 11 complaints of sexual harassment & bullying.
6. Competence: I am the only candidate endorsed by every paper taking a stand (Merc News & Los Altos Town Crier) & the LCV. I also am endorsed by 2 acting Directors against the incumbent - my opponent.
7. Housing: I don't want things blown up. I live in an R1 house. Discrimination is wrong, however.

Rebecca Eisenberg, a Harvard educated lawyer, said at the LWV forum, which I encourage everyone to watch Web Link because Rebecca trounced Kremen, is that she is against the building obsolete dams that will (1) cost the tax payer at least $3 billion; (2) destroy indigenous peoples land; and (3) will lead to the extinction of species. She is also against Kremen's irresponsible water price increases of 15% yearly. Kremen, who is supposedly our representative, is pushing Palo Alto to pay approximately $55m for a waste water treatment plant, which is more than double the amount that the City was quoted originally and to which the City originally agreed. How much more money are the consumers supposed to pay for his schemes?

Here are some of her online posts about Ms. Kou. Regardless of your opinion on housing, this kind of behavior is unacceptable...
"Lydia Kou — really should be required to take Econ 101. Like a couple of the speakers, she fails to understand the universal rule of supply and demand. Repeating the same lie as the earlier speakers, she argues — without basis — that “upzoning” increases prices. (I will opine on this later — TLDR they are lying or incredibly misinformed.)
Lydia Kou — uses the US Constitution in a new and nonexistent way! Bafflingly, Lydia claims that it violates property owners’ rights to equal protection by changing their zoning. First of all, Lydia, the property owner is requesting this zoning change. Second of all, the Supreme Courts of both the United States and California have established that public-interest and compliance-based changes to zoning does not implicate and cannot possibly violate the US or California Constitution.
On the other hand, numerous court cases have held the exact opposite to what Lydia claims: failure to provide inclusive housing DOES in fact violate the US and California Constitutions in many instances!
This is one of countless examples of instances where Lydia Kou has misrepresented the law and facts in order to deceive public opinion. Her actions are intolerable."

Wow "Fixthecreek" how long did it take you to find that? I am sure that you have no interest in supporting Kremen ;).
As you know, two current board members, Barbara Keegen, Linda J. LeZotte, Ann Revel, Larry Stone, the San Jose Mercury News, The Los Altos Crier, and the Honorable LaDoris Cordell, all support Rebecca.
Meanwhile, Kremen, is currently under investigation for "a series of complaints accusing him of bullying and other abuses of power. See Web Link I think you would agree that kind of behavior is much worse and cannot be tolerated.

I really like Councilperson Kou. When I was zoom-bombed by a misogynist and possibly anti-semitic caller, Ms. Kou was the only member of Council to call me to express her concern. That meant a lot to me. Like countless other women, I have been a victim of stalking, harassment, and attempted assault, so incidents like that can be disquieting. It is helpful to hear a kind word like Ms. Kou's.
These mudslinging personal attacks are unwelcome. Plus they distract from the true harasser in the race.
My opponent was forced to step down from his Assessor campaign due to serious allegations of sexual harassment that he continues to dispute with the "It wasn't that bad" defense--lacking any empathy to how his employee may have felt. Legal or not, it was low integrity and un-#MeToo to deny their experience. Web Link
At the Water District, he faces 11 serious complaints of harassment and bullying. According to the SJ Spotlight, "Five of the complaints accuse Kremen of bullying and mistreating Valley Water workers. One employee said they witnessed him making threats to people, and another claims he contributes to a hostile work environment and “culture of fear.”" Web Link
These are serious allegations. While his investigators (managed by his endorsers) struggle over the legalities, should that matter? Poor treatment of staff and community members is never ok, whether or not "illegal." In the private sector, execs are fired after far fewer complaints. I know that as an employment lawyer who represents employees for a living.
Enough is enough. Even one serious complaint of sexual harassment should be disqualifying. District 7 deserves better.

$272,824?!? Whether donated by oneself or others, that’s a boatload of money. We all know how critical water and thus water policy is, but a war chest like Kremen’s begs this question: are all elected positions for sale?
This alone prompts me to take a closer look at his opponent.

This just in, Kremen was found to have violated several district policies when he bullied, verbally assaulted and threatened district workers. Drain the swamp at the Water Commission, vote Rebecca Eisenberg!

You can find the actual report posted here (Web Link The report concludes there are 10 instances of verified abuse of power/harassment of employees and others, including the Sierra Club. Really disturbing report that is being ignored by this publication.
