Here's my comment:

There may have been two sides to the story, with Alvarez already a criminal having a small amount of creditability, until Alvarez walked back, when May was already down, and fired the kill shot into Richard May's head.

If Alvarez was truly scared, he would have run when the cop went down. I don't see a frightened victim of a hostile cop, I see a cold blooded cop killer.
