Foothill continues talks with city and other sites

The City of Palo Alto was one of eight groups scheduled to negotiate property with the Foothill-De Anza Community College District in closed meetings Wednesday.

It seems crazy that so many Palo Alto families have to go outside of Palo Alto to practice gym-based sports, when we have 3 nice gyms at Cubberley. Foothill College offers a lot of classes there but they don't really need gyms for them, as they are yoga, dance, step aerobics etc. This is not a great deal for tax payers, who pay for the Community Center as Foothill only pays about 25% of the total cost the City pays in rent to PAUSD. We pay but don't have access unless one of Foothills classes suits us.

The potential future resonances between Foothill and our community, and Foothill and PAUSD, are massive, and too important to ignore. If we lose the Foothill campus opportunity, we are going to be kicking ourselves in not too many years.

"The district board made no final decision after the Wednesday meetings, which lasted three hours, according to spokesperson Becky Bartindale.

Under the Brown Act, the district is not required to reveal which of the eight property negotiators listed on a meeting notice it met with, she said. She added that disclosing property deals before details were final would jeopardize the district's ability to get the best price."

I haven't seen the agenda for the closed session, but the description in the Weekly article by spokesperson Becky Bartindale indicates the meeting may have violated the Brown Act.

The policy decision about whether to negotiate with a particular property owner or to choose one or more property owners from among a group of property owners with whom to negotiate is a decision that must be made in open session.

A closed session to give instructions to negotiators about price and terms of payment is legal only after a decision is made in open session about which property is the subject of negotiations.

The board cannot simply list a large number of properties in its agenda notice to hide from the public which property is actually the subject of negotiations, and the board cannot go into closed session on real estate matters without identifying any property.

Members of the Foothill College Board of Trustees and Staff were at a meeting of the Midtown Association last night to discuss their future options with regard to building a Campus for Foothill College in either Mountain View, Sunnyvale or Palo Alto.

We learned last night that buying or leasing Palo Alto's 8 acres at Cubberley is still their favorite option. They are well aware that if they move their programs to another location they will lose students. Also, Cubberley is centrally located with several nearby bus lines.

They really want to work with the School District, the PAUSD Adult School, the City's Community Services Department, and the Campus for Jewish Life so that classes can be coordinated between the different programs. They also have plans for expanding their offerings into entrepreneurship, community services, lifelong learning etc.

They are eager to be part of the community and make available to the Community their facilities when they are not using them. Foothill at Cubberley will be a great benefit to Palo Alto.

They should consider the Sears site on San Antonio.
