The Kristine Fitzhugh Case

Jury to hear Fitzhugh motive evidence
Judge ruled this morning

Santa Clara County Superior Court Judge Franklin Elia ruled today that the jury will be allowed to hear evidence concerning Kenneth Fitzhugh's possible motive for murdering his wife, school teacher Kristine Fitzhugh, last year.

In a motion filed last week, Defense Attorney Michael Fletcher wrote that he is planning to argue that Fitzhugh killed Kristine because she revealed that she was about to tell her oldest son Justin that Fitzhugh was not his father.

In an order filed this morning, Elia wrote that "this evidence is both relevant and sufficiently probative to qualify for admission into evidence."
