Baby Izack murder trial begins
Three-month-old boy was shot while in his car seat during lying-in-wait attack

The trial of an East Palo Alto man accused in the 2011 shooting death of 3-month-old Izack Jimenez Garcia is scheduled to begin Nov. 27.

Fabian Zaragoza and an unidentified accomplice allegedly sprayed the car in which Izack sat with 15 bullets on June 5, 2011, fatally shooting the boy in the head.

The boy's family was preparing to leave a party on Wisteria Drive in East Palo Alto when they were attacked. The assailants mistook Izack's parents for Sureno gang members who had beaten up Zaragoza in Redwood City on May 31, police said.

Ivonne Garcia Lopez and Oscar Jimenez were injured during the attack but survived. A fourth occupant, Garcia Lopez's 3-year-old son, was not injured because she had shielded him with her body, police said.

The shooting outraged the East Palo Alto community and set forth a dismantling of gangs by law enforcement.

Zaragoza, who was 17 1/2 years old at the time of the shootings, is being tried as an adult. He has been charged with murder, the special circumstance of lying in wait, two counts of attempted murder with the infliction of great bodily injury, and use of a firearm in the commission of the crimes. He faces life in prison without the possibility of parole if convicted.

Judge Clifford Cretan will begin hearing trial motions and jury selection on Tuesday. Evidence before the jury will begin in early January, San Mateo County District Attorney Steve Wagstaffe said. Zaragoza remains behind bars without bail.

This child's death must be avenged. If this man is truly responsible, let's make sure he never sees the light of day.

This is the sickest crime I have ever heard of. This psychopath should be locked away for good, death is too east and kind for him.
