The city of Palo Alto is suing a man who crashed into a police car in January 2012 and injured the driver, a Palo Alto police sergeant.
According to court documents, Edward Malimban of Redwood City was driving eastbound on Lytton Avenue on Jan. 19, 2012, and "negligently drove his vehicle so as to collide" with the car driven by Detective Sergeant Brian Philip.
The accident caused "great bodily injury" to Philip. The city is suing Malimban to recoup the money it spent on medical treatment and workers' compensation benefits for Philip.
"The city is self-insured," said Sandra Blanch, assistant director of the city's Human Resources department. "There's no insurance company. … Essentially we're trying to, in this case, trying to recover our benefit and program costs."
The amount the city is suing for has not yet been determined, according to the lawsuit.
The lawsuit was filed on Jan. 9, because the statute of limitations was going to run out, Blanch said. A hearing has been set for May 13.
